    The People Space Leaders Academy is a member-only resource. The purpose is to allow members to share knowledge, advice and resources with other members in a secure and supportive environment. Please view theguidelines point 10 for further information

The terms “we,” “us,” and “our” refer to On and Off Communications Ltd, trading as The People Space. The term the “Site” refers to academy.thepeoplespace.com and peoplespaceleaders.com. The terms “user,” “you,” and “your” refer to site visitors, customers, members and any other users of the site.

  1. Service
People Space Leaders Academy (https://academy.thepeoplespace.com and www.peoplespaceleaders.com) is a membership site for online training, courses, resources and other content relating to personal and professional development for HR and people leaders (the “Service”).
Use of peoplespaceleaders.com, including all materials presented herein and all online services provided by The People Space, is subject to the following Terms and Conditions. These Terms and Conditions apply to all site visitors, customers, and all other users of the site. By using the Site or Service, you agree to these Terms and Conditions, without modification, and acknowledge reading them.
Parties agree that the Service is in the nature of education and professional networking. The scope of services provided by The People Space according to this Agreement are limited to those listed on academy.thepeoplespace.com website. The People Space reserves the right to substitute services equal to or comparable to the services listed if the need arises, without prior notice.
  1. Use of the site and service

To access or use the Site, you must be 18 years of age or older and have the requisite power and authority to enter into these Terms and Conditions. Children under the age of 18 are prohibited from using the Site. Information provided on the Site and in the Service is subject to change. The People Space makes no representation or warranty that the information provided, regardless of its source (the “Content”), is accurate, complete, reliable, current, or error-free. The People Space disclaims all liability for any inaccuracy, error, or incompleteness in the Content.

  1. Account creation

In order to use the Service, you will be required to provide information about yourself including your name, email address, username and password, and other personal information. You agree that any registration information you give to The People Space will always be accurate, correct, and up to date. You must not impersonate someone else or provide account information or an email address other than your own. Your account must not be used for any illegal or unauthorized purpose. You must not, in the use of the Service, violate any laws in your jurisdiction.

  1. Lawful purposes

You may use the Site and Service for lawful purposes only. You agree to be financially responsible for all purchases made by you or someone acting on your behalf through the Site. You agree to use the Site and to purchase services or products through the Site for legitimate, non-commercial purposes only. You shall not post or transmit through the Site any material which violates or infringes the rights of others, or which is threatening, abusive, defamatory, libellous, invasive of privacy or publicity rights, vulgar, obscene, profane, or otherwise objectionable, contains injurious formulas, recipes, or instructions, which encourages conduct that would constitute a criminal offense, give rise to civil liability, or otherwise violate any law.

  1. Refusal of service

The Services are offered subject to our acceptance of your order or requests. We reserve the right to refuse service to any order, person or entity, without the obligation to assign reason for doing so. No order is deemed accepted by us until payment has been processed. We may at any time change or discontinue any aspect or feature of the Site or Service, subject to us fulfilling our previous responsibilities to you based on acceptance of your payment.

  1. Order confirmation

    We will email you to confirm the placement of your order and with details concerning product delivery and ongoing payments. In the event that there is an error in this email confirmation, it is your responsibility to inform us as soon as possible.

  2. Duration of agreement
Once confirmed, we will provide you access to the purchased Service. You agree and understand that access to the Service may at times be influenced and affected by third parties that we use to provide the Service (web hosting, site plugins, etc.). You agree and understand that no breach of contract action may be initiated against The People Space when there are reasonable delays in the access of the Service.
The People Space reserves the right to terminate the Service, and or access to certain features of the Service, with or without prior notice to you. We will make reasonable efforts to provide notice but is not required to do so under the terms of this agreement.
Lifetime Access is for the lifetime of the Service. If for any reason, The People Space should dissolve or cease to exist, then your access to the Service terminates.
If you are paying on a monthly subscription this allows you access to the Service for 30 days. Failure to pay your monthly subscription payment will result in access to the Service being stopped.
For annual subscriptions you will receive 365 days access. You may cancel the automatic renewal of your annual subscription at any time and your access to the Site will end at the end of the current contracted term.
  1. Cancellations and refunds
We offer a 14 day money back guarantee should you be unhappy with the Service in your first month of membership. To request a refund please email admin@peoplespaceleaders.com.
You may also cancel your monthly subscription at any time via your account page, but due to the nature of the Service no refunds will be made for any membership fees already paid, excluding the 14 day money back guarantee as stated above.
Once you cancel you will no longer have access to the Service, including all content and community resources, once your current membership period is completed.
The 14 day refund period only applies to your first subscription and cannot be used more than once.
No partial refunds are given should you terminate an annual subscription before your renewal date, however you will retain access to the Service until the end of your annual payment term.

It is entirely your responsibility to ensure that you cancel your account in good time should you no longer require the Service and do not wish to be billed further.

  1. Product description

We endeavour to describe and display the Service as accurately as possible. While we try to be as clear as possible in explaining the Service, please do not accept that the Site is entirely accurate, current, or error-free. From time to time we may correct errors in pricing and descriptions. We reserve the right to refuse or cancel any order with an incorrect price listing.

Intellectual property and copyrights

  1. Material you submit to the site
You shall not upload, post or otherwise make available on the Site any artwork, photos, or other materials (collectively “Materials”) protected by copyright, trademark, or other proprietary right without the express written permission of the owner of the copyright, trademark, or other proprietary right, and the burden of determining that any Materials are not so protected rests entirely with you. You shall be liable for any damage resulting from any infringement of copyrights, trademarks, or other proprietary rights, or any other harm resulting from such a submission. For all Materials submitted by you to the Site, you automatically represent or warrant that you have the authority to use and distribute the Materials, and that the use or display of the Materials will not violate any laws, rules, regulations, or rights of third parties.
As a feature of the Service, The People Space provides access to a community platform. You agree that your use of this community platform is a privilege and The People Space may limit or deny access to these platforms for misconduct that includes but is not limited to being inappropriate, rude, violent, or threatening. The People Space will make reasonable efforts to provide notice to you with regards to inappropriate or unapproved content that you have placed within the voluntarily provided community and social media platform. The People Space is not required to provide notice, and reserves all rights to take immediate and appropriate action to protect The People Space’s brand and image integrity.
 
13. Intellectual property rights to your materials

We claim no intellectual property rights over the material you supply to The People Space. You retain copyright and any other rights you may rightfully hold in any content that you submit through the Site or Service. Content you submit to The People Space remains yours to the extent that you have any legal claims therein. You agree to hold The People Space harmless from and against all claims, liabilities, and expenses arising out of any potential or actual copyright or trademark misappropriation or infringement claimed against you. By posting material on the Site, you grant us a worldwide, nonexclusive, irrevocable license to use the material for promotional, business development, and marketing purposes.

You consent to recordings being made of calls or webinars provided as part of the Service. You consent to your name, words, voice, and likeness being used by The People Space for promotional, business development, and marketing purposes, without compensation to you. We will make reasonable effort to secure your written permission before using and distributing recordings, print materials, audio, or visual representations that refer to you.
  1. Our intellectual property
The Site and Service contain intellectual property owned by The People Space, including trademarks, copyrights, proprietary information, and other intellectual property. The People Space’s copyrighted and original materials are provided to you as part of the Service for your individual use only and a single-user license. All intellectual property, including The People Space’s copyrighted materials shall remain the sole property of The People Space. No license to sell or distribute our materials is granted or implied unless expressly granted as part of your membership package.
You may not modify, publish, transmit, participate in the transfer or sale of, create derivative works from, distribute, display, reproduce or perform, or in any way exploit in any format whatsoever any of the Site or Service Content or intellectual property, in whole or in part, without our prior written consent. This includes but is not limited to sharing material with others, posting excerpts of material on any social media, blogging about the material, or in any other way that would reasonably appear to share the Site or Service’s information with a non-member. We reserve the right to immediately remove you from the Service, without refund, if you are caught violating this intellectual property policy.
  1. Changed terms

We may at any time amend these Terms and Conditions. Such amendments are effective immediately upon notice to you by us posting the new Terms and Conditions on this Site. Any use of the Site or Service by you after being notified means you accept these amendments. We reserve the right to update any portion of our Site and Service, including these Terms and Conditions, at any time. We will post the most recent versions to the Site and list the effective dates on the pages of our Terms and Conditions.

  1. Limitation of liability

YOU AGREE THAT UNDER NO CIRCUMSTANCES SHALL WE BE LIABLE FOR DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, EXEMPLARY, OR ANY OTHER DAMAGES ARISING OUT OF YOUR USE OF THE SITE OR SERVICE. ADDITIONALLY, THE PEOPLE SPACE IS NOT LIABLE FOR DAMAGES IN CONNECTION WITH (I) ANY FAILURE OF PERFORMANCE, ERROR, OMISSION, DENIAL OF SERVICE, ATTACK, INTERRUPTION, DELETION, DEFECT, DELAY IN OPERATION OR TRANSMISSION, COMPUTER VIRUS, OR LINE OR SYSTEM FAILURE; (II) LOSS OF REVENUE, ANTICIPATED PROFITS, BUSINESS, SAVINGS, GOODWILL OR DATA; AND (III) THIRD PARTY THEFT OF, DESTRUCTION OF, UNAUTHORIZED ACCESS TO, ALTERATION OF, OR USE OF YOUR INFORMATION OR PROPERTY, REGARDLESS OF OUR NEGLIGENCE, GROSS NEGLIGENCE, FAILURE OF AN ESSENTIAL PURPOSE AND WHETHER SUCH LIABILITY ARISES IN NEGLIGENCE, CONTRACT, TORT, OR ANY OTHER THEORY OF LEGAL LIABILITY. THE FOREGOING APPLIES EVEN IF THE PEOPLE SPACE HAS BEEN ADVISED OF THE POSSIBILITY OF OR COULD HAVE FORESEEN THE DAMAGES. IN THOSE STATES THAT DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR THE DAMAGES, OUR LIABILITY IS LIMITED TO THE FULLEST POSSIBLE EXTENT PERMITTED BY LAW. IN NO EVENT SHALL WE THE PEOPLE SPACE’s CUMULATIVE LIABILITY TO YOU EXCEED THE TOTAL PURCHASE PRICE OF THE SERVICE YOU HAVE PURCHASED FROM THE PEOPLE SPACE, AND IF NO PURCHASE HAS BEEN MADE BY YOU THE PEOPLE SPACE’s CUMULATIVE LIABILITY TO YOU SHALL NOT EXCEED $100.

  1. Third party resources

The Site and the Service may contain links to third party websites and resources. You acknowledge and agree that we are not responsible or liable for the availability, accuracy, content, or policies of third party websites or resources. Links to such websites or resources do not imply any endorsement by or affiliation with The People Space. You acknowledge sole responsibility for and assume all risk arising from your use of any such websites or resources.

  1. Indemnification

    You shall indemnify and hold us harmless from and against any and all losses, damages, settlements, liabilities, costs, charges, assessments, and expenses, as well as third party claims and causes of action, including, without limitation, attorney’s fees, arising out of any breach by you of any of these Terms and Conditions, or any use by you of the Site or Service. You shall provide us with such assistance, without charge, as we may request in connection with any such defence, including, without limitation, providing us with such information, documents, records, and reasonable access to you, as we deem necessary. You shall not settle any third party claim or waive any defence without our prior written consent.

  2. Effect of headings

The subject headings of the paragraphs and subparagraphs of this Agreement are included for convenience only and shall not affect the construction or interpretation of any of its provisions.

  1. Entire agreement, waiver

This Agreement constitutes the entire agreement between you and The People Space pertaining to the Site and Service and supersedes all prior and contemporaneous agreements, representations, and understandings between us. No waiver of any of the provisions of this Agreement by The People Space shall be deemed, or shall constitute, a waiver of any other provision, whether or not similar, nor shall any waiver constitute a continuing waiver. No waiver shall be binding unless executed in writing by The People Space.

  1. Notices

    All notices, requests, demands, and other communications under this Agreement shall be in writing and properly addressed as follows:

  1. Recovery of litigation expenses

    If any legal action or any arbitration or other proceeding is brought for the enforcement of this Agreement, or because of an alleged dispute, breach, default, or misrepresentation in connection with any of the provisions of this Agreement, the successful or prevailing party or parties shall be entitled to recover reasonable attorney’s fees and other costs incurred in that action or proceeding, in addition to any other relief to which it or they may be entitled.
  1. Severability

    If any term, provision, covenant, or condition of this Agreement is held by an arbitrator or court of competent jurisdiction to be invalid, void, or unenforceable, the rest of the Agreement shall remain in full force and effect and shall in no way be affected, impaired, or invalidated.

  2. Transfer of rights

    The People Space reserves the right to assign or transfer all or any of its rights and obligations under these website Terms and Conditions to any of its companies or to any other third party. In the event of assignment or transfer to any other third party, notification will either be given to you by email or posted on the website.

The purpose of this site is to allow you to exchange ideas, views, advice and resources with other members in a secure and supportive environment. These Guidelines are here to help you understand what it means to be a contributor to the network. You are reminded that your use of this community is subject to these guidelines.

The People Space does not allow people to post anonymously to the community. People Space Leaders Academy is about sharing honestly and transparently.

Do think about the relevance of what you share and confidentiality of any discussions taking place. Also please respects others’ views and cultures.

Please be aware of any copyright issues of anything you choose to share.

Please do not provide details that identify individuals without their consent when discussing professional issues.

Do not make abusive or libellous comments about other people or organisations or publish any content that would put The People Space in legal jeopardy.

By contributing to People Space Leaders Academy, you agree to receive private messages from other users with whom you are connected through the private electronic message which preserves the confidentiality of your email address. While you consent to receiving messages in this way, you are under no obligation to respond to the message sender although we hope you will do so in the spirit of collaboration we are fostering.

These website Terms and Conditions are governed by and will be interpreted in accordance with English and European law. The English courts shall have exclusive jurisdiction to settle any claim or dispute which may arise out of or in connection with these website Terms and Conditions.

We wrote this policy to help you understand what information we collect, how we use it, and what choices you have. People Space Leaders Academy is the membership arm of The People Space ™ . The People Space works with HR and people leaders to help them easily access trusted, independent and actionable knowledge on the changing workplace so they can get future fit fast without being overwhelmed.

What information do we collect and Why?

This Application collects some Personal Data from its Users which are used for the following purposes:

We also collect some Personal Information about the User while they Register their Account, their contact details including their First Name, Surname, Email Address and Contact Number which will be kept confidential from other users and will be shared with others only after the user's consent & permission. While Sign Up, users accept these "Terms and Policy" before providing such details.

 

Reason for Use: These details are used to have the unique identity of each user in People Space Leaders Community.

Information collected from Device:

When Users of the Community access the app, we do collect some personal information of the User's Device like Email Address and Contact Numbers, which is done only after User's consent. This App asks permission if the user allows accessing these details and only after the consent these details are used in the Application.

 

Reason for Use: These details are used to add connections with mutual users of the Device and People Space Leaders Community.

On and Off Communications, trading as The People Space, is the owner of the information collected on the Websites. We will not sell, share, transfer or rent any personal information to others in ways different from what is disclosed in this Privacy Policy, the Terms & Conditions and the Terms of Use. We collect information from you on the "Sign Up" and "Log in” pages ("Profile Pages") of the App. The information collected by us may be in the form of ‘personal information’ or sensitive personal data and information (SPI), under the SPI Rules.

Personal information means any information that relates to a natural person, which, either directly or indirectly, in combination with other information available or likely to be available with a body corporate, is capable of identifying such person.

The sensitive personal data and information related to : 

- User Name, Email Address, and Password

- Gender

- Location

- Profile Picture

- Contact Number

Access to Password Protected/Secure Areas

Only users with login passwords can access the password-protected areas of People Space Leaders Community. The user identity shall be provided by us while the user shall define the login password, which shall be encrypted and stored on the server. We strongly recommend that the password is retained confidential. A password is an authentication tool and we recommend that each User periodically changes the password. 

Note to Users:

  1. During the collection of information on the Profile Pages on the Websites, you are required to provide your applicable contact information (such as name, e-mail address or phone number). 
  1. All the sensitive information is collected only when you provide us your consent. We would discontinue our services if your consent is not received (you affirm your consent by accepting our terms and conditions).
  1. Users are responsible to manage the information they provide us. You can amend your personal information in case of any changes. If you provide any information that is untrue, inaccurate, out of date or incomplete (or becomes untrue, inaccurate, out of date or incomplete), People Space Leaders has reasonable grounds to suspect that the information provided by you is untrue, inaccurate, out of date or incomplete, we may, at its sole discretion, discontinue the provision of the Services to you.

Location-based interactions

We are first taking consent from Users before allowing the app to access their location. 

 Reason for Use: Access of Location is used for the purpose of filtering the content across the app based on selected Location or set default location of the app as per the user's requirement.

Account Deletion 

The users of the People Space Leaders Community do have the right and access to delete their Account from the Platform. If done so, all the relevant data collected and saved on the server would be permanently removed from the database as well as the Server and there will no further details saved at our end.

GDPR Compliance

If you’re a user or visitor in the European Economic Area these rights also apply to you. We are compliant with the appliance of GDPR (General Data Protection Regulation 2016/679) Compliance.
 

What information do we collect?

We collect information in two ways:

  1. When you give it to us or give us permission to obtain it.

When you sign up for or use our products, you voluntarily give us certain information. This can include your name, profile photo, comments, likes, email address you used to sign up, and any other information you provide us. How do we share the information we collect?

People use this website to connect and share relevant content. When you post public updates, anyone can view them. You may also provide us with profile page information that anyone can view. The other limited instances where we may share your personal information include:

We may also share aggregated or non-personally identifiable information with our partners or others.

Our Policy on Children’s Information

We are not directed to children under 13. If you learn that your minor child has provided us with personal information without your consent, please contact us.


Personal Information


a. Information collected within the Community 

We also collect some Personal Information about the User and their contact details including their first name, surname, email address and Contact Number which will be kept confidential from other users and will be shared with others only after the user's consent & permission. These details are used to have the unique identity of each user in People Space Leaders Community.

Other personal information in the Profile including photographs and other details that will be made available to other users only when the User agrees to allow this information to be shown to other users. At any time a user can view the information that will be shown to other users and can change or modify this information by selecting “Edit Profile” from the Website.

b. Information of the Device

When Users of the Community access the app, we do collect some personal information of the User's Device like Email Address and Contact Numbers, which is done only after User's consent. These details are used to add connections with mutual users of the Device and People Space Leaders Community.
